EmpowHer Fitness Client Liability Waiver

Acknowledgment of Risk, Release of Liability, and Assumption of Risk

I, the undersigned participant (“Client”), wish to participate in fitness activities, classes, personal training sessions, or other programs (collectively, “Activities”) offered by EmpowHer Fitness, a women’s only fitness studio (“the Studio”). In consideration of being permitted to participate in the Activities, I understand, acknowledge, and agree to the following:

1. Acknowledgment of Health and Physical Condition

I represent that I am in good physical health and have no medical conditions, injuries, or impairments that would prevent me from safely participating in the Activities. I have consulted with a physician prior to engaging in any physical exercise or fitness program at the Studio, and I have been cleared to participate. I agree to inform the Studio immediately of any changes in my health or physical condition that may affect my ability to participate safely.

2. Assumption of Risk

I understand that participation in the Activities involves inherent risks, including but not limited to muscle strains, sprains, fractures, cardiovascular complications, dizziness, fainting, or other injuries, including serious injury or death. These risks may arise from my own actions, the actions of others, the condition of the equipment or facilities, or the nature of the Activities themselves. I knowingly and voluntarily assume all such risks, whether known or unknown, associated with my participation in the Activities.

3. Release and Waiver of Liability

In consideration of being permitted to participate in the Activities, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue EmpowHer Fitness, its owners, officers, employees, instructors, agents, or representatives (collectively, “Released Parties”) from any and all claims, demands, damages, losses, or liabilities, including those arising from negligence, related to any personal injury, property damage, or death that may occur as a result of my participation in the Activities or use of the Studio’s facilities, equipment, or services.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, costs, damages, or liabilities, including reasonable attorney’s fees, arising out of or related to my participation in the Activities, including claims brought by third parties as a result of my actions.

5. Use of Equipment and Facilities

I agree to use all Studio equipment and facilities in a safe and proper manner, following any instructions or guidelines provided by the Studio’s staff. I understand that improper use of equipment may increase the risk of injury, and I assume full responsibility for any injury or damage resulting from such misuse.

6. Media Release

I grant EmpowHer Fitness permission to use my likeness, voice, or image in photographs, videos, or other media taken during Activities for promotional or marketing purposes, without compensation. If I do not wish to be included in such media, I will notify the Studio in writing prior to participation.

7. Voluntary Participation

I acknowledge that my participation in the Activities is voluntary, and I may discontinue participation at any time. I understand that the Studio reserves the right to refuse or terminate my participation if it believes my actions or condition pose a risk to myself or others.

8. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of [Insert State/Province and Country]. Any disputes arising from this Waiver or my participation in the Activities shall be resolved in the courts of [Insert Jurisdiction].

9. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment of Understanding

I have read this Waiver in its entirety, fully understand its terms, and sign it freely and voluntarily without any inducement. I am aware that this is a release of liability and a contract between myself and EmpowHer Fitness, and I agree to be bound by its terms.
